Before you can make an application to the court for a parenting order, or to change an existing parenting order, you need to try family dispute resolution. Exceptions to this include where there is family violence, child abuse or the matter is urgent. If the dispute cannot be resolved using family dispute resolution, you will need a certificate from the family dispute resolution practitioner who helped you before going to court.

Childrens Matters
It is always the childs right to know BOTH parents and to be protected from harm. Equal shared parental responsibility does not necessarily mean equal time. When considering a parenting order the courts may apply the presumption that both parents share equal time, but only when the court believes it is appropriate. Shared parental responsibility refers to ensuring the child has access to food, clothing, shelter, school, social advancement, medical and welfare such as protection from harm. It is BOTH parents responsibility to ensure these needs are met.

Parenting Agreements
A Parenting agreement is an agreement that separated parents make about how their children will be cared for and supported. The benefit of preparing one together with the assistance of a mediator is that you can make decisions that suit your own individual circumstances. Agreeing about how things that affect your children are going to be organised, as openly as possible, will be good for your children and is likely to save arguments or misunderstandings along the way. We explain to all parents that the best interests of their children are the most important thing them to consider when making an agreement.
